Our Client, Mr X worked as a Kitchen Fitter with the defendant company. In his role he would be expected to drive to different sites around the UK to work. He would be involved in the fitting of kitchen units, cupboards and worktops. This would also involve repairing and remedial work. Mr X was expected to unload various tools from his van and then carry these to the area the he was expected to work. Mr X was frequently involved in the lifting of work tops, cupboards and tools.
Mr X was unloading a chop saw from his van and was placing it down when he felt a sudden, sharp shooting pain in his back. He recalls the weight of the chop saw being in the region of 20 kgs. Following the accident our client did complete an accident form and he advised his manager at the time, what had happened. Following the accident Mr X advises that he could not stand up straight and he felt it was difficult for him to complete his chores. The defendant company subsequently arranged a number of physiotherapy sessions for Mr X and he returned to work when he felt well enough to.
After returning to work Mr X was placed in the office for 2 weeks and then was put back onto normal duties. After the accident Mr X was still expected to lift and manoeuvre heavy cabinets often weighing between 50 to 70 kgs on his own. The defendant company failed to risk assess the environment in which Mr X was working even upon his return to work.
As a result of the accident and due to the nature of the heavy lifting which was expected in his job, Mr X was diagnosed with a 5 year acceleration of his injury, which meant that his current symptoms were brought on by work 5 years earlier then they normally would have been expected of someone of his age.
